Residential Residential or Commercial Property Foreclosures (Info And Procedures) - Financial Regulation


The Office of Financial Regulation is accountable for the development and/or guidance of specific aspects of the foreclosure process involving domestic home and gets specific notices and registrations connected to the foreclosure procedure. Specifically, the Office promotes guidelines concerning the types, series of documents, and certain processes to be used as part of the foreclosure process, including, however not limited to:

- the format and content of the Notice of Intent to Foreclose, the template loss mitigation application, the initial loss mitigation affidavit, the final loss mitigation affidavit, the notice to accompany the order to docket;

  • the fee, notification, application and guidelines for prefile mediation, and a mediation checklist that describes the matters that will be evaluated and considered in a prefile mediation; and
  • the request kind for postfile mediation, the documents and details to be offered by each party to the mediation, and a mediation checklist that describes the matters that will be evaluated and considered in a postfile mediation

    .18. Foreclosure Notices and Registrations

    The Office administers Maryland's Foreclosure Registration System, a web-based application for submission of the foreclosure-related notifications and registrations that are mandated by Maryland law. Specifically, the system enables licensed users to send and/or search the following foreclosure-related notifications and registrations:

    - The Notice of Intent to Foreclose is a caution notification to the house owner that a foreclosure action could be filed versus them in court. It needs to be sent out by licensed and top-notch mail to the property owner no less than 45 days before a foreclosure action might be filed in court. Pursuant to Maryland law and policy, a copy of the Notice of Intent to Foreclose must be electronically submitted to the Commissioner through the Foreclosure Registration System within 5 organization days of a Notice of Intent to Foreclose. The Commissioner does not accept submissions in any other manner. Filing a copy of the Notice of Intent to Foreclosure with the Commissioner need to be achieved before a party is licensed to file an action to foreclose a mortgage or deed of trust on domestic property. Failure to abide by this requirement will subject a violator to the enforcement jurisdiction of the Commissioner. Refer to Md. Code Ann., Real Prop. § 7-105.1(c)and COMAR 09.03.12.02.- The Notice of Foreclosure offers specific details regarding domestic property topic to a foreclosure and must be submitted within 7 days of the filing of an order to docket or a problem to foreclose a mortgage or deed of trust on the home.     7-105.2.-The Foreclosed Residential or commercial property Registration is planned to track owner contact details for foreclosed residential or commercial properties between the date of the foreclosure sale and recordation of the deed moving the residential or commercial property to the new owner. The Foreclosed Residential or commercial property Registration consists of contact information for the buyer, the party responsible for upkeep of the residential or commercial property, and the entity licensed to accept legal service on behalf of the purchaser, in addition to other relevant information such as whether the residential or commercial property is understood to be inhabited, the date of the sale, and the date of court ratification. This information is intended, in part, to permit local governments to resolve problems associated with the residential or commercial property, such as code enforcement, problem abatement, residential or commercial property maintenance, police, public safety, public health, emergency services (fire, EMS), to notify public law (i.e. data collection to determine patterns, develop policy actions, etc), and to help in the collection of relevant taxes. Within one month after a foreclosure sale of home, a foreclosure purchaser will send a Preliminary Registration ($50 filing charge if timely/$100 filing charge if late) and within 1 month after a deed moving title to the house has been tape-recorded, the foreclosure buyer will send a Last Registration (no filing charge).     .14. After Initial Registration, and within 21 organization days of a change, a foreclosure buyer must update its registration with any modification in 1) the name and address of the person, including a substitute buyer, who is licensed to accept legal service for the foreclosure purchaser, 2) if understood, the occupancy/vacancy status of the residential or commercial property, 3) the name, phone number, and street address of the person who is accountable for the maintenance of the residential or commercial property, and 4) the status of whether the foreclosure purchaser has belongings of the residential or commercial property.

    NOTE: Specific notification and registration info in the Foreclosure Registration System is normally personal and is not public information. Maryland State and City government Officials may be licensed in their official capability to see Notices of Foreclosure or Foreclosed Residential Or Commercial Property Registrations (for their particular jurisdictions only) by developing a Federal government User account in the Foreclosure Registration System. Additionally, a homeowner's association or condo in which a residential or commercial property in concerns is located, or an individual who owns residential or commercial property on the same block as a residential or commercial property in concern, may ask for from OFR or local jurisdiction specific info associated to a Notice of Foreclosure or Foreclosed Residential Or Commercial Property Registration. See Md. Code Ann., Real Prop. § § 7-105.2(c)( 3) & 7-105.14(g)( 3 ).

    Except as kept in mind above, OFR is prohibited from supplying info relating to specific residential or commercial properties to the public. System users besides State and regional government officials only have access to those notifications and registrations that they have actually sent. The Office is not allowed to offer lists of foreclosed residential or commercial properties to the general public.
